General Terms and Conditions (T&C)

These Terms and Conditions apply to all contracts for the services of the GLOBALBACK platform concluded via the websites globalback.de and globalback.com.
§ 1 Scope and provider
(1) The provider and contracting party is Detlef Eschner (sole proprietorship), Moerserstr. 62, 47239 Duisburg, Germany (hereinafter „GLOBALBACK“ or „we“). Contact: phone +49 2151 6006849, e-mail: email@globalback.de. GLOBALBACK is a registered trademark.
(2) These T&C apply to all contracts concluded via our websites in the version valid at the time the contract is concluded.
(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding the contract, acts in the exercise of their commercial or independent professional activity.
(4) Deviating terms and conditions of the customer do not become part of the contract unless we expressly agree to their validity.
§ 2 Description of services
(1) GLOBALBACK provides an internet platform that supports the recovery of lost items. The core service is the provision of a unique GLOBALBACK-ID (GBID) and, optionally, an entry in the GLOBALBACK Cloud (proof of ownership or authenticity).
(2) Via the GBID, a finder can contact the owner of a marked item without the owner’s personal contact details being disclosed. Contact is made through our platform (anonymised mediation).
(3) This is a purely digital service. The delivery of physical items (e.g. finished stickers or tags) is not part of the contract; customers mark their own items themselves. GLOBALBACK provides guidance and tools for this (e.g. QR code generation).
(4) The status of an item marked with a GBID can also be queried via connected GLOBALBACK check portals. GLOBALBACK is entitled to make the mere status query available for this purpose to connected or cooperating portals, including via a technical interface (API); only the publicly available information (identification number, status and, where applicable, a telephone number released by the owner) is provided. Further details are set out in our privacy policy.
(5) GLOBALBACK owes the provision of the platform and the GBID, but not a specific outcome in the sense of the return of a lost item (see § 8).
§ 3 Conclusion of contract
(1) The presentation of services on our websites does not constitute a legally binding offer but an invitation to place an order.
(2) By submitting the completed order form, the customer makes a binding offer to conclude a contract.
(3) The contract is concluded as soon as we confirm the order or provide the service. An automatic acknowledgement of receipt by e-mail does not yet constitute acceptance, unless it also declares acceptance.
(4) We store the contract text and send the order data to the customer by e-mail. The contract language is German.
§ 4 Prices and payment
(1) The prices stated on the website at the time of the order apply. Currently, the following in particular apply to consumers:
- 1 GLOBALBACK-ID: €10.95
- 3 GLOBALBACK-IDs: €21.90 („3 for 2“ promotion)
(2) A one-time setup fee of €4.95 is waived as part of an introductory promotion until 31 December 2026.
(3) All prices are final prices. As a small business within the meaning of § 19 of the German VAT Act (UStG), we do not charge or show value added tax.
(4) Payment is made at your choice by PayPal or by bank transfer (advance payment). In the case of advance payment, you will receive our bank details with the order confirmation; the service is provided after receipt of payment.
§ 5 Provision, term and renewal
(1) The GBID and cloud entry are provided for a fixed term of three years, beginning with activation.
(2) The contract does not renew automatically. The customer has the option to extend the term by a further three years each time. If no extension is made, provision ends upon expiry of the term; the GBID and the associated cloud entry are then deactivated and deleted.
(3) We will notify you of the renewal option in good time before expiry, provided a valid e-mail address is on file.
§ 6 Right of withdrawal for consumers
Consumers have a statutory right of withdrawal. The following withdrawal policy applies.
Withdrawal policy
Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which the contract is concluded.
To exercise your right of withdrawal, you must inform us (Detlef Eschner, Moerserstr. 62, 47239 Duisburg, Germany, e-mail: email@globalback.de, phone: +49 2151 6006849) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your notification concerning the exercise of the right of withdrawal before the withdrawal period expires.
Consequences of withdrawal. If you withdraw from this contract, we shall reimburse you all payments received from you without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal. For this repayment we use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.
Early performance. If you requested that the service should begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the service already provided up to the point of withdrawal.

§ 7 Obligations and permitted use
(1) The customer warrants that the data they provide is correct and keeps it up to date.
(2) The customer is responsible for keeping their access data confidential.
(3) The customer may not use the platform improperly, in particular may not mark items belonging to others, stolen or infringing items and may not make false statements of ownership or authenticity. GLOBALBACK is entitled to block entries in the event of justified suspicion of misuse.
§ 8 No guarantee of success
(1) GLOBALBACK provides solely the technical platform and the mediation of contact between finder and owner.
(2) GLOBALBACK gives no warranty that a lost or missing item will actually be found, reported or returned. Whether a finder reports and returns an item is beyond GLOBALBACK’s control.
(3) GLOBALBACK is not a party to any return or finder’s reward and is not liable for the conduct of finders or third parties.
§ 9 Liability
(1) GLOBALBACK is liable without limitation in cases of intent and gross negligence as well as for damage arising from injury to life, body or health.
(2) In the case of simple negligence, GLOBALBACK is liable only for the breach of a material contractual obligation (cardinal obligation), the fulfilment of which is essential for the proper performance of the contract and on whose observance the customer may regularly rely. In this case, liability is limited to the foreseeable damage typical of the contract.
(3) Any further liability is excluded. Liability under the German Product Liability Act remains unaffected.
(4) GLOBALBACK is not liable for the temporary unavailability of the platform where this is due to disruptions outside its own area of responsibility (e.g. force majeure, disruptions of the hosting provider).
§ 10 Defects
The statutory provisions on warranty or on the rights in the event of defects in digital products apply. If the customer is an entrepreneur, the limitation period for claims due to defects is one year, insofar as legally permissible.
§ 11 Special conditions for resellers and business customers
(1) Separate conditions apply to resellers: the price is €8.00 per GBID with a minimum purchase of 10 units.
(2) With respect to entrepreneurs: the right of withdrawal under § 6 does not apply. The liability provision of § 9 applies accordingly.
(3) Resellers are obliged to independently comply with the applicable statutory obligations (in particular withdrawal and information obligations) towards their own end customers.
§ 12 Contract term and termination
(1) The contract ends upon expiry of the agreed term (§ 5), unless it is renewed.
(2) The right to terminate for good cause remains unaffected for both parties.
§ 13 Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 14 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country of their habitual residence.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from the contractual relationship is the registered office of GLOBALBACK.
(3) Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions remains unaffected.
